Terms of Service for Pool Hall Master

1. Agreement to Terms

By accessing or using the Pool Hall Master mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Pool Hall Master provides a waitlist management system that allows users to join waitlists at participating pool halls and receive notifications when their table is ready. The Service includes:

• Digital waitlist registration

• SMS notifications for waitlist updates

• Real-time waitlist status tracking

• Communication with participating pool hall establishments

3. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

4. User Accounts and Registration

4.1 Account Information

To use certain features of the Service, you must provide accurate and complete information, including:

• Your full name

• A valid phone number

• A valid email address

4.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account information

• All activities that occur under your account

• Notifying us immediately of any unauthorized use of your account

You agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided is inaccurate, not current, or incomplete.

5. SMS Communications

5.1 Consent to Receive SMS

By providing your phone number, you consent to receive automated SMS text messages from Pool Hall Master regarding your waitlist status and other service-related notifications.

5.2 Opt-Out

You may opt out of receiving SMS messages at any time by:

• Texting "STOP" to any message you receive from us

• Contacting us at privacy@poolhallmaster.com

• Adjusting your notification settings in the app

5.3 Message Rates

Standard message and data rates may apply based on your mobile carrier's plan. You are responsible for any charges incurred.

5.4 Message Frequency

Message frequency varies depending on waitlist activity and your use of the Service.

6. Acceptable Use

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms.

6.2 Prohibited Conduct

You agree NOT to:

• Use the Service in any way that violates any applicable laws or regulations

• Provide false or misleading information when registering or using the Service

• Impersonate any person or entity or misrepresent your affiliation with any person or entity

• Use the Service to harass, abuse, or harm another person or entity

• Interfere with or disrupt the Service or servers or networks connected to the Service

• Attempt to gain unauthorized access to any portion of the Service

• Use automated systems (bots, scripts, etc.) to access the Service

• Abuse the waitlist system by making multiple fake reservations

• Use the Service for any commercial purpose without our express written permission

7. Intellectual Property Rights

7.1 Our Ownership

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Pool Hall Master, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

7.3 Restrictions

You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service

• Remove or alter any copyright, trademark, or other proprietary rights notices

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by Pool Hall Master. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Our Service uses:

• Twilio for SMS messaging services

• Netlify for hosting and backend infrastructure

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. POOL HALL MASTER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement

• Warranties regarding the availability, reliability, or accuracy of the Service

• Warranties that the Service will be uninterrupted, secure, or error-free

• Warranties regarding the accuracy or completeness of any content

We do not guarantee that:

• Your table will be available at the estimated time

• You will receive notifications at any specific time

• The Service will meet your specific requirements

• Participating venues will honor the waitlist

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POOL HALL MASTER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, or goodwill

• Service interruption

• Computer damage or system failure

• Cost of substitute services

This applies whether such damages arise from:

• Your use or inability to use the Service

• Any unauthorized access to or use of our servers

• Any bugs, viruses, or similar components transmitted through the Service

• Any errors or omissions in any content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Pool Hall Master and its licensors, affiliates, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms

• Your use of the Service

• Your violation of any rights of another party

• Your violation of any applicable laws or regulations

12. Modification and Termination

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

• Pool Hall Master is a technology platform that facilitates waitlist management

• We are not responsible for the operation, policies, or availability of individual pool halls

• Participating venues may have their own terms, policies, and rules that apply to your visit

• Waitlist estimates are approximate and subject to change

• Venues reserve the right to refuse service in accordance with their own policies

15. No Agency Relationship

No agency, partnership, joint venture, employer-employee, or franchiser-franchisee relationship is intended or created by these Terms or your use of the Service.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

17. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Pool Hall Master.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pool Hall Master regarding the Service and supersede all prior agreements and understandings, whether written or oral.
